Employee Conflict of Interest Forms

A "local government officer" is any SWISD employee who exercised discretion in the planning, recommending, selecting, or contracting of a vendor.  Local government officer includes members of the board, the superintendent, or an agent (including an employee) of the District.

 

Section 176.003 of the Local Government Code requires certain local government officers to file a Conflicts Disclosure Statement if:

 

(1) The vendor enters into a contract with SWISD or SWISD is considering entering into a contract with the vendor; and

(2) The vendor:

(A) has an employment or other business relationship with the SWISD employee or a family member of the SWISD employee that results in the SWISD employee or family member receiving taxable income, other than investment income, that exceeds $2,500 during the 12-month period preceding the date that the SWISD employee becomes aware that:

(i) A contract between SWISD and the vendor has been executed; or
(ii) SWISD is considering entering into a contract with the vendor;

(B) has given to the SWISD employee or a family member of the SWISD employee one or more gifts that have an aggregate value of more than $100 in the 12-month period preceding the date the SWISD employee becomes aware that:

(i) A contract between SWISD and the vendor has been executed; or
(ii) SWISD is considering entering into a contract with the vendor; or

(3) Has a family relationship with the SWISD employee.

 

"Contract" means a written agreement for the sale or purchase of real property, goods or services. Contract includes a purchase order, quote, contract/agreement and memorandum of understanding.

 

Does YOUR purchase require the filing of a Conflicts Disclosure Statement?

If an SWISD employee who took part in planning, recommending, selecting, or contracting with the vendor whose name appears on the Purchase Order has a conflict as described above, this form MUST be completed by that SWISD employee and submitted to the SWISD Purchasing Department via email at [email protected] not later than 5 p.m. on the seventh business day after the date on which the SWISD employee becomes aware of the facts that require the filing of this statement.

 

It is a misdemeanor offense not to comply with this section of Chapter 176 of the Texas Local Government Code. Refer to chapter 176 of the Texas Local Government Code for detailed information regarding the requirement to file this form.
